Mini Session Booking Agreement
1. Payment for Session
The client understand and agrees to pay the full Mini Session payment within four (4) days of the invoice being sent to secure the date and time of their appointment. Your booking is not confirmed until your payment + Booking Agreement has been received. The photographer agrees to not make any other booking or accept any other client for the agreed date and time, once payment and Booking Agreement has been received. Mini Sessions are first in, first secured; if your desired slot is confirmed before your payment is received, you will have the option to book another slot.
1a. What the Payment Includes
The clients understands that there are five (5) digital files included in their payment. Your payment covers the time and talent of the photographer, the use, cleaning and maintenance of props and/or wardrobe, and the wear and tear of equipment used during your session. It covers the time and effort put into creating your beautiful gallery of images, from selecting, culling, editing and finishing right through to presenting them in your gallery. Digital files are the art the photographer has produced and are priced accordingly. The client understands that they have the option to upgrade to their Full Gallery or Full Gallery + Professional Prints or any other package available.
2. Payment for Orders
The client understands and agree that all payments are due in full on specified dates. Orders will not be processed until payments have been made. Orders will be placed after the final payment has been made.
3. Following the Prep Guides
The client understands that it is important to follow the instructions provided in the Prep Guides associated with the clients chosen session. The information provided in the guide is designed to best prepare the client and the client's children and/or newborn for their session. The instructions need to be followed correctly by the client in order for the photographer to provide the best outcome for the portraits. Should the client not cooperate fully with the instructions, resulting in children and/or newborn being unable to finish the session, the photographer is unable to guarantee the number of images in the client's gallery. Should the client be unhappy with the number of images in the client's gallery, when non-cooperation has occurred, the photographer is not liable.
4. Cancellation of booking
The client understands and agrees that where the client cancels their session, they FORFEIT their payment. In the first instance, the client has the option to book at a later date, either a Mini or Full photography session. If the client wishes to re-book at a later date, they understand that their payment will be transferred to secure their new date and time. It is at the photographers discretion that a payment may be refunded in extenuating circumstances.
5. Sickness
The client understand and agrees that in the event that either party is unable to proceed with the session due to sickness, that the session can be rescheduled to a date and time agreeable to both parties. Reasonable notice must be given if a family member or photographer is unwell. If the client fails to advise the photographer of sickness and attends their session, they may be asked to leave and have the session rescheduled. The client understands that this will be when and able the photographer is next available, and only when the
client is fully recovered.
6. Selecting Images
The client understands and agrees that selections must be placed within three (3) days of receiving their gallery. Where the client wishes to upgrade to the Full Gallery, they will be available to do so through the shop on their gallery and will therefore receive a download link with instructions, within one (1) hour. Purchased images will be archived for six (6) months and any unordered images will be deleted. If an order is not placed within three (3) days of receiving the gallery, a $25 fee will incur to reopen that gallery.
7. Editing + Colour Variants
The client understands and agrees that their gallery will consist of a mixture of colour and black and white, representative of my creative style. Not all images will be delivered in both colour and black and white. Any additional editing after your gallery has been delivered, may incur / acquire additional charges. The Client releases the Photographer from any and all liability relating to colour reproduction of supplied works on any system not under the direct control of the Photographer. Where a colour is unable to be reproduced accurately due to limitations in capture and output technology, the Client releases the Photographer from any and all liability in regard to colour reproduction.
8. Backup
Kim May Photographer does keep a back up of all images for up to six (6) months, but is not responsible for the loss of images or for maintaining backups of the client's images once they have been delivered to the client. If the client requests an additional download of the gallery after their initial paid download has occurred, the client understands that a full gallery download cost will be charged to do so.
9. Photography Release
The client hereby grants Kim May Photography and its legal representatives the irrevocable and unrestricted right to use and publish photographs of the client or in which the client may be included, for editorial, trade, advertising or any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The client hereby releases Kim May Photographer and its legal representatives and assigns from all claims and liability relating to the photographs. It is agreed that Kim May Photographer may display and use the photographs taken for advertising, display, website and internet promotion, photogenic contexts, public displays such as in photography books, studio display, magazine advertising and any other purpose thought proper by Kim May Photographer. Photography businesses are built on imagery, it is how you find photographers and how other find them in the future. As a result, photographs need to be shared images from shoots in a public forum in order to continue to market the services, However, if you would not like any of your images used in any advertising, please comment on the client agreement form.
